The wishes of a killed worker's family underpinned a safety regulator's decision to accept a $968,000 enforceable undertaking (EU) in lieu of a category 2 WHS prosecution, the regulator's chief executive has told OHS Alert.

Two major employers have entered enforceable undertakings totalling $636,000 - with one already spending $500,000 on rectifications - after workers were potentially exposed to hazardous respiratory environments.

Two employers, including one that covered a dangerous ventilation shaft with a thin layer of concrete, have been ordered to pay a total of $235,000 in fines and costs, after workers sustained serious limb injuries. Meanwhile, another company has entered a $160,000 safety undertaking after a customer was injured.

A Rio Tinto subsidiary has entered the first enforceable undertaking under the Northern Territory's mirror WHS Act, and committed to a large minimum spend of nearly $1 million.
