A workplace team leader breached privacy rules by using an expired certificate of capacity, involving a psychological injury, to determine that a worker wasn't suitable for a higher role, a tribunal has declared.

A worker who attempted to return to work after suffering a non-work-related injury has been awarded $44,000 in damages, after a court found his employer discriminated against him by ignoring medical advice and refusing to make reasonable adjustments to accommodate his return.

"Workplace-directed" programs appear to be the most successful return-to-work (RTW) interventions for employees on sick leave with burnout, according to researchers, who stress that successful RTW hinges on early intervention.

A worker has unsuccessfully challenged the outcomes of his return-to-work grievances, with a commission finding there was no evidence he was provided an unsafe workplace or his employer should have launched an investigation into his bullying and harassment complaints.

An injured worker who was assessed as being at "high risk" of relapsing into alcohol misuse has won a reinstatement order, with a commission finding her 18-month abstinence suggested she was fit for employment.

An injured worker who continually dodged her return-to-work appointments was validly dismissed for "obfuscation", but her employer's overall handling of her termination made it unfair, a commission has ruled.

A government employer's interpretation of the obligation to provide injured workers with "suitable employment" could result in a worker's entitlement to such work ending "upon the completion of the shift in which the workplace injury occurred", a tribunal full bench has found.
