An employer took adverse action against a train driver - following a train crash - in sacking him for failing to undertake a competency assessment when he felt "violently ill", the Federal Circuit Court has found.

BHPB failed to act on 1962 asbestos risk, worker awarded $360k

BHP Billiton Ltd has been ordered to pay a former worker, who now has mesothelioma, nearly $360,000, after the South Australian District Court rejected its claim that in the early 1960s it didn't have "actual knowledge" that low asbestos exposure was hazardous.
