BHPB failed to act on 1962 asbestos risk, worker awarded $360k

BHP Billiton Ltd has been ordered to pay a former worker, who now has mesothelioma, nearly $360,000, after the South Australian District Court rejected its claim that in the early 1960s it didn't have "actual knowledge" that low asbestos exposure was hazardous.

OHS regulators could push for jail terms to bypass insurance loophole

Insurance policies that cover directors' OHS fines - as seen in the Adelaide desalination plant case - will force regulators to seek jail terms for offenders, or to have such contracts declared void under consumer laws, two prominent legal experts have told OHS Alert.

Director handed record OHS fine, but how much will he pay?

An employer and its director were yesterday handed the highest OHS fines in South Australian history, after the death of a worker at the Adelaide desalination plant. But the director's fine will be paid by his insurance company, and the judge in the case has warned that officers could similarly dodge penalties under the model WHS Act.

Employers fined $420k over death and repeat guarding offence

Employers in Victoria and South Australia have been fined a total of $420,000 for safety breaches, after one worker was fatally crushed by a falling steel beam, and another sustained serious arm injuries on a machine involved in an earlier breach.

New firefighter cancer Bill a "slap in the face" for volunteers

The South Australian Government today will formerly introduce its workers' comp cancer Bill for career firefighters, which, unlike a nearly identical Greens Bill currently before Parliament, provides no cover for the State's 13,500 firefighting volunteers. Also in this article, Unions NSW has declared today "Fair Go for Workers' Compensation Day".
