High Court rejects motel claim, clarifies Hatzimanolis

The High Court has found that a Commonwealth employee who was injured while having s-x in her motel room on a work trip is not entitled to workers' compensation, effectively narrowing the application of the Hatzimanolis test for work-interval injuries.

Review of Seacare's poor safety record recommends harmonisation

Injured workers can claim under two Acts

A recent NSW Court of Appeal decision shows that non-Commonwealth licensees can still be found liable under state workers' compensation schemes for injuries caused by a "gradual process", according to a Curwoods Lawyers report.

More vigilance flagged for assessment of psych injury claims

The Commonwealth SRC Act will be amended to limit the definition of "reasonable administrative action" in psychological injury disputes, under a Government plan to prioritise 21 of the 137 recommendations made by the Hanks and Hawke review of the Act.
