BHPB failed to act on 1962 asbestos risk, worker awarded $360k

BHP Billiton Ltd has been ordered to pay a former worker, who now has mesothelioma, nearly $360,000, after the South Australian District Court rejected its claim that in the early 1960s it didn't have "actual knowledge" that low asbestos exposure was hazardous.

Worker's 30th RTW plan implemented with "undue haste"

A return-to-work plan must be proposed to an injured worker and his or her doctor before it is formally introduced, the South Australian WCT has ruled, in finding an employer implemented a worker's plan with "undue haste", aggravating his psych injury.

Injured employee offered 35 minutes in long service leave wins in court

A South Australian employer that claimed a casual employee - with a long-term work-related injury - was eligible, at best, for the equivalent of 35 minutes' pay in long service leave entitlements, has been ordered to recalculate the benefit based on 20 years of service.
